England Student Support: 'Tigere' interim policy

Students with discretionary leave, or limited leave to remain, have not been entitled, in England, to ‘home’ fee status or Student Support. This has been successfully challenged in the Supreme Court case of Tigere. As a result of the judgment in this case, which was given on 29 July 2015, the Department for Business, Innovations and Skills (BIS) will amend the current Student Support regulations following consultation. It has issued interim guidance on how to assess eligibility for Student Support. However, as yet there is no corresponding interim provision for assessing fee status. We have asked BIS whether any such interim provision will also be put in place.
