UKCISA statement on government announcement warning students not to overstay their student visa
September 03, 2025
UKCISA and its members work to support the government in maintaining the integrity of the immigration system. UKCISA provides specialist advice, guidance and training on the immigration requirements for students. We work to ensure that international students’ experience of the immigration system is transparent and fair, and that they understand where to seek appropriate information and advice.
The recent announcement warning students not to overstay their student visa is not a new message. Overstaying on a student visa has always risked serious consequences, and because of this, student sponsors continuously advise students to help ensure they protect their immigration status throughout their studies. There are many genuine reasons that individuals may feel unsafe to return to their home country, and this should be acknowledged by the government and by the media reporting on policy proposals and asylum. Deciding to apply for asylum has consequences for those who apply for it. It is an important and life-changing decision. It requires specialist regulated advice, and there is no guarantee that any application will be successful.
International students are also a frequent target for scams, particularly those focusing on their immigration status. We are concerned that the tone of messaging to students will not only increase their anxiety but potentially make them even more vulnerable to fraud and scams pretending to be from official sources.
We are seeking clarification on the details of the policies and the full and exact communications that students will receive from government. We will share these with our members as soon as it is confirmed to ensure students receive the support they need.
For any international students concerned about the communications they receive relating to their immigration status, please reach out to those available to support you within your educational institution, for example, your international student advisers or student services. UKCISA also offers support via our advice line for students, and you can find more information on how to seek specialist credible immigration advice on our website.
